BOOKING TERMS AND CONDITIONS

By booking or participating in an experience, tour, or any related product or service offered by Nomadex, you agree to these Booking Terms and Conditions.

By booking a tour, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are making a booking on behalf of other participants, you guarantee that you have the authority to accept and agree to these Terms on behalf of all participants in your group.

1. THE BOOKING CONTRACT

Your booking is confirmed, and a contract exists when Nomadex issues a written confirmation after receiving the required deposit. Please check your confirmation carefully and inform Nomadex immediately of any incorrect or incomplete information. Ensure that the names match exactly as they appear on the corresponding passport.

You must be at least 18 years old to make a booking. You agree to provide complete and accurate information to Nomadex.

2. DEPOSITS

At the time of booking, a non-refundable deposit of 25% of the total amount is required per person and per tour. The remaining 75% must be paid 24 hours prior to the date of the tour. Nomadex will issue a service voucher. Please refer to your service voucher for details regarding final payments, including how to make the payment. For certain products or services, such as TailorMade tours, alternative deposit terms may apply. Deposits for TailorMade bookings are not transferable.

3. FINAL PAYMENT AND ACCEPTANCE OF THE RESERVATION

If we accept your booking, we will issue you with a booking confirmation invoice. A contract will exist between you and us from the date we issue the confirmation invoice or If a booking is made less than 48 hours (2 days) before the departure date, the total amount must be paid at the time of booking.

Payment of the balance of the trip price is due 24 hours (2 days) before the departure date. If this balance is not paid on or before the due date we reserve the right to treat your booking as cancelled and any cancellation charges outlined at clause 5 (Cancellation by the Participant) will apply.
If the payment terms for any reserved product or service differ from those described in this section, the applicable terms will be communicated to you before booking and will also be detailed in the corresponding invoice.

Nomadex is not responsible for any charges levied by third parties or financial institutions, which you will pay as a result of a credit card or other payment transactions, and will not refund or return any charges imposed by third parties or financial institutions related to payments made by you to Nomadex.

4. BOOKING ON BEHALF OF OTHERS

When booking on behalf of other participants, you are deemed the designated contact person for each participant included in that booking. This means you are responsible for:

  • Making all payments due concerning the booking,
  • Notifying Nomadex of any required changes or cancellations,
  • Keeping your group informed.

By booking on behalf of others, you declare and warrant that you have obtained all necessary consents. You are responsible for verifying that any information provided on behalf of another participant is complete and accurate. Nomadex is not liable for any errors or omissions in the information provided to complete a booking.

5. CANCELLATION BY THE PARTICIPANT

You may cancel your Booking by notifying Nomadex. Cancellation fees, if any, will be determined with reference to the date Nomadex receives the cancellation notice and will be expressed as a percentage of the total price paid for the canceled Tour, product, or service (excluding any insurance products).

Cancellation of a Tour:

Cancellation received 30 days or more before the departure of the tour or service in the corresponding booking: Nomadex will retain the Lifetime Deposit in accordance with these Terms, and the remainder of the payments made to Nomadex regarding the canceled product will be refunded.

Cancellation received between 10 and 2 days before the departure of the first product or service in the corresponding reservation: Nomadex will retain the Lifetime Deposit in accordance with these Terms, and an amount equivalent to 50% of the remaining payments made to Nomadex regarding the canceled Tour will be refunded.

Cancellation less than 2 days before the departure of the first product or service in the corresponding reservation: Nomadex will retain the Lifetime Deposit in accordance with these Terms, and no further refund will be paid.

6. GUARANTEED DEPARTURES AND TOUR CANCELLATION BY NOMADEX

A departure date for a Tour offered by Nomadex will become a guaranteed departure when at least one booking with a valid deposit has been made for that departure.
Nomadex guarantees that all scheduled Tour departures booked and secured with a valid deposit will depart as indicated in the corresponding confirmation, subject to reasonable itinerary changes as described in these Terms or good-faith health and safety concerns. This guarantee does not apply in the case of Force Majeur.

If a Tour is cancelled by Nomadex before the date of departure for reasons other than Force Majeure or as a result of a suspension of operations by Nomadex and the cancellation is not caused by your fault or negligence, you will have the choice of accepting from Nomadex:

(a) a substitute Tour of equivalent or superior value; or
(b) a substitute Tour of lesser value if no Tour of equivalent or superior value is reasonably available and to recover from Nomadex the difference in price between the price of the Tour originally purchased and the substitute Tour; or
(c) a full refund of all monies paid for the cancelled Tour.

If a cancellation due to Force Majeure or a suspension of operations by the Nomadex occurs after the Tour has commenced, Nomadex can offer you either a pro-rata:

(a) travel credit valued at 110% of the monies paid for the days that remain on your Tour; or
(b) refund minus unrecoverable costs of the days that remain on your Tour.

Any travel credit Nomadex issues as a result of a Tour that is cancelled for Force Majeure:

  • Will have an expiration date that is no sooner than 2 years from the date of Tour cancellation;
  • Is not redeemable for cash;
  • Excludes flights or insurance.

Nomadex is not responsible for any incidental expenses or consequential losses that you incur as a result of the cancelled booking including visas, vaccinations, non-refundable flights or rail, non refundable car parking or other fees, loss of earnings, or loss of enjoyment, Nomadex reserves the right to issue a full refund in lieu of the choices above, in its sole discretion. Where a significant element of a Tour as described cannot be provided after departure, Nomadex will make suitable alternative arrangements where possible. If it is not possible to provide a suitable alternative or if you reasonably reject any suitable alternatives, Nomadex may provide you with a refund for unused products or services as determined in its discretion.

7. SPECIAL REQUIREMENTS

Any special requirements must be disclosed to Nomadex at the time of booking. Nomadex will make reasonable efforts to accommodate special requests but cannot guarantee their fulfillment due to the nature of the destinations visited and the availability of options outside a planned itinerary.
Certain activities may be inaccessible if your mobility is limited. All food allergies and dietary restrictions must be disclosed at the time of booking, but Nomadex cannot guarantee that all needs can be accommodated.
Special requests are not part of these Terms or the contract between you and Nomadex. Nomadex is not responsible for any failure to accommodate or fulfill such requests.

8. AGE REQUIREMENTS

Anyone under 18 years old on the date of the first travel segment is considered a minor. Minors must always be accompanied by an adult. One adult may accompany up to two minors. Unless otherwise stated in the Tour description or by Nomadex, the minimum age for minors traveling on any Tour is 12 years old.

All bookings with a minor are subject to review and approval by Nomadex. The accompanying adult is responsible for obtaining all necessary consents and documentation required for the minor to travel and ensuring compliance with all legal requirements for travel.

Nomadex will not be held liable for fees, damages, or losses resulting from the failure to obtain the necessary consents or approvals. Each adult in a booking with a minor is jointly and severally responsible for the behavior, welfare, supervision, and control of the minor(s) and accepts these Terms on behalf of the minor(s). Nomadex does not provide childcare services and expressly disclaims liability for accompanying or supervising minors.

9. PRICES, SURCHARGES, AND TAXES

Nomadex will not increase the price of your Tour after you have paid in full. Tour prices include applicable taxes.

Occasionally, Nomadex may offer reduced prices on certain products or services. These reduced prices apply only to new bookings. Bookings for which Nomadex has already received at least a deposit are not eligible for reduced prices.

10. VALIDITY

All Tour dates, itineraries, and prices are subject to change at any time. The new price will be quoted and confirmed at the time of booking, subject to any applicable surcharges in accordance with these Terms.

11. INFORMATION REQUIRED FOR BOOKING

As a condition of booking, you must provide the information requested by Nomadex along with the final payment. Failure to provide the required information for tickets, permits, or other inclusions may result in additional costs, fees, or losses, including the inability to secure or provide such inclusions.

If you fail to provide the required information, Nomadex reserves the right to treat your booking (or the relevant portion) as canceled and charge cancellation fees as deemed reasonable.

Nomadex will not be held liable for any costs incurred due to errors, omissions, or delays in the information you provide.

12. AIRFARE

Tour prices do not include international or other airfare unless explicitly stated in the Tour description. Nomadex will quote the best available price for requested travel dates at the time of booking. These quotes are estimates and not guaranteed price commitments.

Nomadex is not responsible for changes in flight itineraries, schedules, or delays and does not provide advice or alerts regarding flight tickets or status.

13. TRAVEL DOCUMENTS

It is your responsibility to obtain and have in your possession all required and identification documents for entry, exit, and travel to each region. This includes a valid passport and all travel documents required by the relevant government authorities, including all visas, permits, and certificates (including, among others, medical or vaccination certificates) and insurance policies. You accept full responsibility for obtaining such documents, visas, and permits before the Tour begins, and you are solely responsible for the full amount of any costs incurred as a result of missing or defective documentation. You agree that you are responsible for the full amount of any loss or expense incurred by Nomadex as a direct result of your failure to obtain or possess the appropriate travel documentation.

Nomadex does not provide advice on travel documents and makes no representations or warranties regarding the accuracy or completeness of any information provided about visas, vaccinations, weather, clothing, luggage, or special equipment, and you agree that Nomadex is not responsible for any errors or omissions in this information.

14. FLEXIBILITY AND UNUSED SERVICES

You acknowledge that the nature of adventure travel requires flexibility and that you will allow reasonable modifications to products, services, or itineraries by Nomadex. The route, timings, accommodations, activities, amenities, and mode of transport are subject to change without notice due to unforeseen circumstances or events beyond Nomadex control (including, but not limited to, force majeure, illness, mechanical failure, flight cancellations, strikes, political events, and entry or border difficulties). No refunds, discounts, or returns will be issued for lost or unused services after departure due to causes beyond Nomadex control, including your removal from a Tour due to negligence or failure to comply with these Terms.

15. CHANGES

Changes made by Nomadex: You may modify your itinerary when reasonably necessary at its sole discretion. If Nomadex makes a change that affects the itinerary or materially affects the nature of a product or service in its entirety (a “Material Change”), Nomadex will notify you as soon as possible.

16. ACCEPTANCE OF RISK

You acknowledge that adventure travel and the products and services offered by Nomadex may involve a significant amount of risk to your health and safety. By traveling with Nomadex, you acknowledge that you have considered any potential health and safety risks. You hereby assume responsibility for all such risks and release Nomadex from all claims and causes of action arising from any loss, damage, injury, or death resulting from the inherent risks of travel, specifically adventure travel.

17. NOMADEX IS NOT RESPONSIBLE FOR THIRD-PARTY PROVIDERS

Nomadex makes arrangements with accommodation providers, transportation providers, activity providers, to provide part or all of the components of your booking. Third-Party Providers may also hire subcontractors. Although Nomadex takes all reasonable precautions when selecting Third-Party Providers, Nomadex cannot control Third-Party Providers, does not supervise them, and therefore cannot be held responsible for their acts or omissions. All services provided by Third-Party Providers are subject to the terms and conditions imposed by these Third-Party Providers, and their liability is limited by their fees, transport conditions, tickets, coupons, and international agreements governing the provision of their services.

18. LIABILITY

Nomadex and its respective employees, affiliates, officers, representatives, and assigns will not be liable for any damage or loss of property or injury or death to persons caused directly or indirectly by any act or omission of any other provider, including, but not limited to, any defect in any vehicle operated or provided by such other provider; and any loss or damage due to delay, cancellation, or interruption in any manner caused by laws, regulations, acts or omissions, demands, orders, or interventions of the government or any subdivision or agent thereof, or by acts of God, strikes, fires, floods, wars, rebellions, terrorism, insurrections, diseases, quarantines, epidemics, thefts, or any other cause beyond its control.
In the event that any loss, death, injury, or illness is caused by negligent acts or omissions of Nomadex or the Third-Party Providers of any service that forms part of the booking contract, Nomadex limits its liability, where applicable, by all applicable international agreements.

19. FORCE MAJEURE

Nomadex will not be liable in any way for death, bodily injury, illness, damage, delay, or other loss or detriment to person or property, or financial costs both direct and indirect incurred, or for failing to begin, perform, or fulfill any duty owed if such death, delay, bodily injury (including emotional distress or injury), illness, damage, or other loss or harm to person or property is caused by an act of God, war or operations similar to war, mechanical failures, terrorist activities or threat thereof, civil unrest, labor difficulties, interference by authorities, political disturbances, riots, insurrections, and governmental control, fires, extreme weather conditions, significant human health risks such as an outbreak of a serious disease, including any mutation or variation, and the continuing effects of Covid-19 or any other cause beyond the reasonable control of Nomadex or the Third-Party Provider of services, whether foreseeable or not, that would make it dangerous or unfeasible for a Tour to begin or continue, all of which, individually and collectively, constitute “Force Majeure.”

20. IMAGES AND MARKETING

You agree that while participating in any Tour, other participants, Nomadex, or its representatives may take images, photos, or videos that may include or feature you. You consent to the taking of such photographs and grant a perpetual, royalty-free, worldwide, and irrevocable license to Nomadex, its contractors, subcontractors, and assignees, to reproduce them for any purpose (including marketing, promotions, and the creation of promotional materials), in any medium, whether now known or devised in the future, with no further obligation or compensation payable to you.

21. PRIVACY POLICY

Nomadex must collect your personal information to deliver the Tour and any product or service booked. Nomadex collects, uses, and discloses only the information reasonably necessary to enable Nomadex and its Third-Party Providers to provide the Tour, products, and/or services you have requested as described in the Nomadex Privacy Policy, which can be accessed at any time. By submitting any personal information to Nomadex, you indicate your acceptance of the Nomadex’s Privacy Policy.

22. CONTRACTING PARTIES AND SUCCESSORS

These Terms shall benefit and be binding upon the parties and their respective heirs, legal and personal representatives, executors, trustees, successors, and assigns.

23. MODIFICATIONS

Nomadex reserves the right to update or modify these Terms at any time and will post the modified Terms on the Nomadex website. Any modification will become effective 10 days after its publication on the Nomadex website. An updated copy of these Terms, with modifications, can be accessed at any time on the Nomadex website and will be sent to you upon written request to Nomadex. You are deemed to have accepted any modification to these Terms on the 10th day after its publication on the Nomadex website. Nomadex recommends that you review the Terms before traveling to familiarize yourself with the most current version available.

24. TRAVEL INSURANCE

Travel insurance is mandatory for all our travellers and must be taken out at the time of booking. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$200,000 for each of the categories of cover. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide your travel insurance policy number and the insurance company’s 24-hour emergency contact number on the first day of your trip; you will not be able to join the trip without these details. If you have travel insurance connected to your credit card or bank account please ensure you have details of the participating insurer, the insurance policy number and emergency contact number with you rather than the bank’s name and credit card details.

25. ADDITIONAL TERMS APPLICABLE TO CERTAIN NOMADES TOURS AND OR SERVICES

TailorMade Tours
The following terms and conditions apply only if you are booking or traveling on TailorMade Tours with Nomadex:

Price validity: Upon receiving your TailorMade booking request, Nomadex will provide you with a quote for the chosen tour. The quoted prices for all TailorMade Tours are valid until the date specified in the quote, after which Nomadex reserves the right to provide you with a revised quote. Any modification to a TailorMade itinerary, including dates or the number of travelers, will be subject to a revised quote.

Payment and cancellation: The full payment for any TailorMade Tour is due 30 days before the departure date of the first service product in your booking. If full payment is not received by the due date, Nomadex may issue a new quote, including a change in the payable fee, or may treat the booking as canceled and, at its sole discretion, retain the deposit paid on the booking as a cancellation fee. If a tour is booked less than 30 days before the departure date of the first product or service in your itinerary that includes TailorMade, then the full amount is due at the time of booking.

In addition to the deposit, certain elements of your TailorMade Tour may be subject to higher or different charges (including different cancellation fees). These charges will apply only when required by our suppliers. If this situation arises, Nomadex reserves the right to request that you make payment of the requested sum within a specified period and before the balance due date. These terms, if applicable, will be communicated to you prior to booking and will also be detailed in your invoice.

You may cancel your booking by notifying Nomadex. Cancellation fees, if any, will be determined with reference to the date Nomadex receives the cancellation notice and will be expressed as a percentage of the total price paid for the canceled tour, product, or service (excluding any insurance or air travel products).

Deposit terms for TailorMade: At the time of booking, a non-refundable deposit of 30% of the tour price per person, per tour, must be made to Nomadex. If the booking is made 30 days or less before departure, full payment is required at the time of booking. The non-refundable deposit must be sent to Nomadex, as appropriate. Deposits paid for a TailorMade trip will not be held as a Lifetime Deposit.

20. IMAGES AND MARKETING

You acknowledge that adventure travel and the products and services offered by Nomadex may involve a significant amount of risk to your health and safety. By traveling with Nomadex, you acknowledge that you have considered any potential health and safety risks. You hereby assume responsibility for all such risks and release Nomadex from all claims and causes of action arising from any loss, damage, injury, or death resulting from the inherent risks of travel, specifically adventure travel.
